Overtime law scam in Illinois to look out for

So assuming you are eligible for overtime (for example, most managers are not eligible for overtime benefits), some employers are trying to cheat employees out of well earned overtime.

In the past we have helped employees who have bosses that change their time sheets, mis-classify their work status, lie and say that they don’t have to pay OT, etc.

But a new scam we’ve been dealing with deals with employees that get paid every two weeks.  They’ll work 45 hours in week one and their boss will only let them work 35 hours in the second for a total of 80 hours over two weeks.  If they make $10 an hour they’ll get paid $800, but they should get $825.  That’s because the first week should include five hour of OT at $15 an hour.  The fact that the worker gets paid every two weeks doesn’t mean anything and there isn’t some magic loophole to avoid what the law is.

As a worker you should keep track of your hours and rest assured that if you are covered under the law, no matter what your employer tells you, the law can be enforced.
