For example, if a man pushes a woman into a wall against her will and grabs her breast, he has committed criminal sexual assault. Furthermore, if a nurse grabs the behind of a heavily sedated patient because of feeling of physical attraction for the patient, the nurse is guilty of criminal sexual abuse.

A person found guilty of this form of criminal sexual abuse has committed a Class 4 felony, which means that anyone found guilty of this can be sent to prison for up to 3 years. If found guilty of the crime more than once, the crime becomes a Class 2 felony, which is punishable by up to 7 years in prison.

If committed in a certain manner or on a certain category of people, the basic charge of criminal sexual abuse can be escalated to the more serious charge of aggravated criminal sexual abuse.

Aggravated criminal sexual abuse occurs when a person commits criminal sexual abuse with the use of a deadly weapon, while causing injury, while threatening the life of another person, or by giving the victim a drug or other controlled substance.

In addition, criminal sexual abuse can be classified as aggravated criminal sexual abuse if the victim belongs to a specific category of people. Criminal sexual abuse upon any of the following groups of victims automatically becomes aggravated criminal sexual abuse:
