Online wills, are they safe?

One of my closest friends called me for a recommendation of an estate planning attorney. He called the lawyer and then called me back wondering why he can’t just fill out on-line forms.

As I told my friend, you "could" pay for on-line forms, but there is a catch. 1. How do you know what you really need? e.g. My friend’s wife is receiving money from an inheritance and they want to keep that money separate. 2. What happens if you have questions? 3. What happens when you need to make a change? 4. How secure are you that the form is done correctly and will do what you want? e.g. If you are creating a will to determine who will have custody of your child if you die isn’t it worth it to know that document was prepared 100% correctly and will survive any challenges?

There are many attorneys out there that focus on Illinois estate planning and often are not much more expensive than on-line forms that aren’t focused on just Illinois. We can’t encourage you enough to go through a lawyer because you only get one shot at this.  It’s not that an on-line form couldn’t be right, but when you consider that the cost savings aren’t that great and the consequences if things are done wrong, we just believe you are risking way too much.

Getting a record expunged or sealed in Illinois isn’t always possible.

It’s not uncommon for us to get a call from someone who wants to clear up their record. Usually it’s because they are having trouble getting a job or are worried about a background check. Many people have sad stories or compelling arguments like, "I was 19, now I’m 34 and have a wife and kid and haven’t been in trouble since then."

Some offenses can be expunged or sealed -retail theft, trespassing, minor drug offenses to name a few. Almost all felonies (except class 4 drug felonies) are on your record forever. Same thing if you have two convictions on your record.

If this is the case then your only option is a pardon from the Governor and that is almost impossible to get.  It may not be fair, but it’s the reality of the law in Illinois.  Any Illinois expungement attorney will tell you the same thing.

So before you please guilty to a crime think of the long term consequences.  If a Judge or attorney tells you that the offense can be taken off of your record, get it in writing.

Why medical malpractice damage caps make no sense

The goal of malpractice lawsuits is to prevent a similar mistake from happening again and compensating the victim.

We were called by an Illinois family whose son died of gross negligence in a Nevada hospital. Two doctors, one at Harvard, one at the Mayo Clinic will testify as to what went wrong. We have learned however that the most that can be recovered in a suit in Nevada is $350,000. We called 20 firms in Nevada to see if they would represent the family and despite the great evidence, none of them would. Most have stopped doing these cases because the risk of what they have to spend to go to trial doesn’t outweigh what can be recovered. Insurance companies know this so they don’t settle any of the cases.

So who wins? Not the public. Not safety. Not good doctors that want to weed out the bad. Just insurance companies. It’s quite sad. Imagine how the family felt when we told them honestly that they had a great case, but we couldn’t help.

No Illinois medical malpractice attorney we know of pursues "frivolous" lawsuits.  The lawyers that take these cases have to spend their own money to pursue a case, usually between $50,000 and $150,000 to get through a trial.  Not every case turns out to be malpractice, but when medical negligence does occur, the victims deserve to be compensated.

Are you kidding me????

With the bad economy, we are getting a lot of calls lately from people that have been terminated. Some have been terminated illegally, most have been let go legally and then some are just nuts.  If you were illegally fired, we’ll help you find a lawyer that can get compensation for you.  If you were fired unfairly, but not illegally, we’ll explain the law to you.  But if you are just looking for something frivolous,  well . . .

A woman that called us was upset that she was terminated for drawing a picture of a penis on the wall and didn’t think that was fair. It reminded me of the Seinfeld episode where George got fired for having sex on his desk with the cleaning lady and acted as if no one had told him that wasn’t allowed.

If you know what you did was wrong sometimes you just have to deal with the consequences.   Despite all of the people that hate lawyers or the concept of lawsuits and despite one lady getting a few thousand dollars from McDonalds for spilling coffee on herself, almost every Illinois attorney we know would not pursue a b.s. lawsuit.

Bond in Illinois drug cases isn’t always simple

Typical situation: Defendant gets arrested and is charged with possession of drugs with the intent to distribute. Judge gives a high bond, say $250,000. Typically you have to post 10% of that to get out. So for $25,000 you are out of jail until the case is decided.

In drug cases it’s not always that simple. The Prosecutor might object to the bond if they think it’s coming from drug sales. In that case you would have to have a special hearing to show where the money is coming from and essentially prove it’s not from a drug sale. Without that you’d sit in jail even if you can pay.

This doesn’t happen a lot, but if it does you better hire a lawyer that knows how to handle those hearings.  Can you imagine being innocent, having the money to bond out of jail and being stuck in jail because they don’t believe that your bond money is legit?  It would be a nightmare to say the least.

A realistic option for avoiding foreclosure in Illinois

We get more and more calls for people who are looking to avoid foreclosure in Illinois.  The law is pretty much brand new since President Obama put new rules in to place earlier this year.

I hear the same ads that you do from companies with toll free numbers not based in Illinois that say they can help.  For the most part these aren’t law firms.  Recognizing that a lot of these outfits just make a bad situation worse by taking money from desperate people and doing nothing, Illinois put forth a law that says no one can take any money from someone trying to avoid foreclosure until they have been successful.

The exception is that attorneys can charge a fee.  The difference is that they will do the work and you can hold them accountable.  If they steal your money you the ARDC can take their license.  If a company in Florida, California or anywhere else takes your money, it’s gone.

“Father’s Rights” lawyers in Illinois. Don’t get tricked by marketing.

About 2-3 times a day we get a call from someone who is looking for a "father’s rights" attorney.  It’s typically a concerned Dad who wants to play a role in the lives of their child. 

Let me be clear:  "Father’s rights" is for the most part marketing that preys upon the fears of a parent.  Child custody  and visitation in Illinois is supposed to be based on the best interests of the child.  Are there times when the Mom gets a better result than the Dad?  Absolutely.  There are also times when a Dad gets custody over the Mom.
