Application for Adjustment of Claim

An application for adjustment of claim ("application") is the form used in every Illinois workers' compensation case to officially file your claim. No matter the facts of your injury, every application has the same information. This form must be filed within three years from your accident date or two years from the last payment of workers' compensation benefits, whichever is later. If you fail to file within those time limits your case would be forever barred.

No matter where your injury occurred, the application for adjustment of claim is filed at the main Illinois Workers' Compensation Commission at the Thompson Center in Chicago. Once the case is filed you (or your attorney assuming you are represented) should send certified notice to your employer with a copy of the application. The Commission will then send notification to all parties with an Arbitrator assignment and a venue location in case there are any disputes. The venue is typically assigned based on the accident location.

Unlike a personal injury lawsuit, there is no charge to file an application for adjustment of claim in Illinois. Even if benefits are being paid we usually suggest to callers that they file an application for two reasons. First, you want to have a case on file in case something goes wrong. Otherwise it could take an additional 30-60 days to get a hearing if your benefits are denied. Second, it is common for an Arbitrator to set multiple hearings on one day. Obviously he can only hear one case at a time. Priority is given to the claims that were filed first in most cases.
