In response to the Great Depression, Congress created the Federal Social Security Act which created disability benefits for retirees, the unemployed, and a one sum payment benefit at death.
There are generally two types of disability compensation benefits: (1) Social Security Disability Insurance Benefits (SSDI) and (2) Supplemental Security Income Benefits (SSI).
Social Security Disability Insurance Benefits (SSDI) are payments to an injured person and certain members of their family. In order for the injured party to qualify, the injured party must have worked long enough and paid Social Security taxes. In general, an injured party may be able to get monthly payments if they cannot work for one year or longer because of a disability.
Supplemental Security Income Benefits (SSI) is a monthly payment by the United States Government to those 65 or older, blind, or disabled based on need. Whether an individual can get SSI depends on where you live, your income, and your possessions. A lawyer will be able to assist in assessing whether you meet the government’s complicated rules for obtaining SSI.
