The Illinois Workers’ Compensation Commission is the state agency that oversees work accidents and injuries in Illinois. Formerly known as the Illinois Industrial Commission, they do not provide legal advice or representation. However, they do monitor all Illinois companies to make sure that they are complying with state laws and they provide Arbitrators to resolve disputes between injured workers and their employers. These hearings are conducted pursuant to the rules of evidence and can be complex so it is highly recommended that anyone with a claim before the Illinois Workers’ Compensation Commission get a lawyer.
The actions of the Illinois Workers’ Compensation Commission are guided by the Illinois Workers’ Compensation Act. It was written in the early 1900’s and then amended in the 1970’s and serves to provide specific benefits to any worker who sustains an on the job injury. The Act requires every employer to provide workers comp benefits to their workers through a workers’ compensation insurance policy or in the case of some large corporations, self insurance. The Act provides benefits to workers who were injured in Illinois, hired in Illinois, but hurt while working in Illinois or injured working in another state for an employer whose principal place of business is in Illinois.
The Illinois Workers’ Compensation Act is a no fault law which means that a worker does not have to prove negligence on their employer in order to receive benefits and an employer can not defend a case by saying an employee was negligent unless that employee was engaged in “horse play” or other activities outside of the scope of employment. In exchange for the no fault aspect of the Illinois Workers’ Compensation Act, employees gave up the right to sue their employers for work related injuries with minimal exceptions.
