Eminent Domain, often called condemnation, refers to the government’s power to seize private property for public use. The property owner must receive just compensation and can contest any attempts to take their property. The process begins with the government presenting the property owner with a formal offer. Occasionally, the government authority taking the property will request a quick take which will allow a court to decide preliminary compensation if the original offer by the government is challenged. If that happens, you may still challenge the court’s decision, but ownership of the property has already been transferred.
