The two types of criminal charges in Illinois are felonies and misdemeanors. A crime that is classified as a misdemeanor could result in no more than 364 days in jail while a felony conviction can lead to much greater sentence and usually can not be taken off of your record. Hence, felonies are much more serious crimes than misdemeanors. The difference between a misdemeanor and felony usually deals with the seriousness of the offense. In other words, if you steal a $20.00 sweater while that is a crime, you would likely get charged with a misdemeanor. On the other hand, if you stole a diamond necklace worth $2,000.00 that would likely be a felony. In each case the prosecution would have discretion to decide exactly what you would be charged with.
The first thing criminal lawyers do is work for the release of defendants from jail on bail if they are still imprisoned. Next, criminal defense attorneys are responsible for analyzing whether evidence against their client was properly gathered. If it wasn’t (e.g. an illegal search of your car) a good criminal defense lawyer will file a motion to have that evidence barred from your case. Before a case proceeds to trial criminal attorneys should assess the strength of their client’s case and their client’s goals in order to see if a plea agreement can be worked out with the prosecutor. If there is a trial, a good criminal defense attorney will aggressively represent your interests.
