Black lung, which is also known as Pneumoconiosis, is an occupational lung disease caused by extended breathing of coal mine dust. A Black Lung attorney represents coal miners in their personal injury cases against mining companies.
After a horrific coal mine explosion in Farmington, West Virginia in 1968 that killed 78 miners, Congress passed The Federal Coal Mine Health and Safety Act of 1969 to address growing concerns with mining safety. The Federal Mine Safety and Health Act of 1977 later amended the previous act. Both acts aimed at establishing better health and safety standards in America’s mines and reducing the occurrence of Black Lung within miners.
It is important to note that the Acts provide for compensation for miners that are disabled from exposure to coal mine dust, in turn holding coal companies directly responsible for compensation and medical costs for black lung victims. Evidence of black lung shows up on a chest x-ray.
