Illinois sexual harassment laws come from federal law under Title VII of the Civil Rights Act of 1964. According to the Equal Employment Opportunity Commission (EEOC) "unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitutes sexual harassment when submission to or rejection of this conduct explicitly or implicitly affects an individual's employment, unreasonably interferes with an individual's work performance or creates an intimidating, hostile or offensive work environment."
There are two types of sexual harassment, both of which are illegal. The first is when a boss, supervisor or other person in authority requests sexual favors or a relationship in exchange for not punishing an employee or in return for a promotion or other employment reward. The second type of sexual harassment occurs from the work environment itself such as crude sexual jokes, comments, pictures or other means that create an intimidating or offensive environment.
If you are experiencing sexual harassment you should report it to a supervisor. In most cases the liability of your employer is based on whether they knew or should have known about the inappropriate behavior and did nothing to stop it.
