Driving Under the Influence ("DUI") is defined as operating a motor vehicle while impaired by alcohol, drugs or other intoxicating compounds. In Illinois it is known by most people that if you are over age 21 and have a blood alcohol count of .08 or higher while driving a vehicle you can be arrested for driving under the influence of alcohol. In fact, you don't even need to be driving to get a DUI in Illinois. Simply sitting in the car with keys in the ignition, even if the car is parked, may be enough to get arrested for a DUI. In addition, if your blood alcohol count is between .05 and .08 you can receive a DUI in Illinois if it is determined that you were impaired in your driving.

If you are under 21 and have any alcohol in your system you could be charged with a DUI if you are pulled over. The same rules apply for bus drivers of any age in Illinois. In other words, a 20 year old who drinks one beer and then drives a car could face the same penalty as a 21 year old who operated a car after drinking 10 beers. While some may argue that is not fair the point is that is the law in Illinois and you need to be aware of it.

Commercial driver's license holders will be charged with a DUI in Illinois if there blood alcohol count is .04 or greater. This law was likely intended to discourage any drinking by over the road truck drivers due to the potential damage that can be caused by a drunk, truck driver.
