In Illinois when injured workers have a dispute with their employer about their right to receive benefits under the Workers Compensation Act, the dispute is resolved through an arbitration. Since these cases are not from lawsuits there is no jury, but rather there is an Arbitrator. The rules of evidence apply to these hearings. Every accident, whether disputed or undisputed will be assigned to an Arbitrator once it is formally filed with the State through an application for adjustment of claim. The Arbitrator has an informal status call on each case every three months and will not assign a trial date without a trial motion until the case is three years old. At that point a hearing must be set unless the Arbitrator grants a continuance.
