We are often called by workers who are owed money for past performance. Many times bad feelings when employment is terminated cause an employer to not pay the money that a worker feels that he is owed. Other times there is no employment agreement in place so it is not clear how much money may be owed.
For smaller amounts we recommend that workers call the Illinois Department of Labor. They do not have enforcement power, but often can help resolve minor payment issues at no cost to the worker. For Illinois workers that are owed a greater amount of compensation we have had a great deal of success in helping them find lawyers that will pursue their claim.
We have also helped people find a lawyer to negotiate a severance package or review a severance proposed by an employer. A severance package is compensation that is offered upon termination of employment. While there is no legal requirement for an employer to offer a severance package, they will often provide them as a good will gesture or a way to resolve any employment based disputes that exist or may exist in the future.
Finally, when an employment offer is made it will also include an employment contract. The contract may include financial terms or a non-compete agreement. A non-compete agreement may prevent an employee from doing the same type of work for a different company or from starting their own firm. It might also prevent a worker from leaving and taking any co-workers or clients with them.
